QUALIA

Terms of Service

Last updated: [Date]

These Terms of Service ("Terms") govern your use of Qualia ("the Service"). By creating an account or using Qualia, you agree to these Terms. If you do not agree, please do not use the Service.

1. About the Service

Qualia is a private space for journaling, reflection, and personal knowledge. You can save text, photos, voice memos, articles, and other content; organize and reflect on them; and optionally share them with other Qualia users or publish them to external platforms.

2. Your account

You must provide a valid email address and keep your password secure. You are responsible for all activity that happens under your account. If you suspect unauthorized access, change your password and contact us immediately.

3. Age and consent

You must be at least 16 years old to create and use a Qualia account on your own behalf. If you are at least 13 but under 16, you may only use the Service with the verifiable consent of a parent or legal guardian who has reviewed and agreed to these Terms and our Privacy Policy on your behalf. The parent or guardian is responsible for the minor's use of the Service.

Qualia is not intended for children under 13. If you are under 13, do not use the Service or provide us with any personal information. If we learn that an account belongs to someone under the applicable age threshold without proper consent, we will delete the account and associated data.

4. Your content

You own everything you create in Qualia. We do not claim ownership of your journal entries, photos, notes, or any other content you upload. By using the Service, you give us a limited license to store, display, and process your content solely for the purpose of operating Qualia and providing features you request.

You are responsible for what you share. Do not use Qualia to store, share, or publish content that is illegal, abusive, harassing, defamatory, hateful, or that infringes on someone else's rights.

5. Privacy

Your use of Qualia is also governed by our Privacy Policy. The Privacy Policy explains how we collect, use, and protect your personal data.

6. Acceptable use

You agree not to:

  • Use Qualia for any illegal purpose.
  • Harass, threaten, or harm others through the Service.
  • Attempt to access, disrupt, or interfere with our systems or other users' accounts.
  • Upload malware, viruses, or other harmful code.
  • Scrape, harvest, or systematically collect data from Qualia without permission.
  • Impersonate another person or misrepresent your identity.

7. Account suspension and termination

We may suspend or terminate your account if you violate these Terms, if we are required to do so by law, or if we reasonably believe your use poses a risk to the Service or other users. You may delete your account at any time. Upon termination, your right to use the Service ends, and we will delete your data as described in the Privacy Policy.

8. Changes to the Service

We are constantly improving Qualia. We may add, change, or remove features at any time. We will try to notify you of significant changes, but we make no guarantee that any specific feature will remain available forever.

9. Disclaimers

Qualia is provided "as is" and "as available." We do not guarantee that the Service will always be available, error-free, or secure. We are not responsible for any loss of data caused by your device, your internet connection, or circumstances outside our reasonable control.

AI-generated summaries, transcripts, and suggestions are tools to assist you. They may not be perfect. We are not responsible for decisions you make based on AI output.

10. Not a health or crisis service

Qualia is a personal journaling tool. It is not therapy, medical or mental-health care, and it is not an emergency or crisis service. Nothing in the Service is professional advice, and AI features are not a substitute for a qualified professional.

We do not scan, monitor, review, or flag your entries for any subject matter, including self-harm. Writing something in Qualia does not alert anyone and does not summon help.

If you are in crisis: in the United States, call or text 988 (Suicide & Crisis Lifeline) or text HOME to 741741. Elsewhere, findahelpline.com lists free, confidential support by country. If someone is in immediate danger, contact your local emergency number.

11. Limitation of liability

To the fullest extent permitted by law, [Your Business Entity Name] and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Qualia, even if we were advised of the possibility of such damages. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the claim, or one hundred US dollars, whichever is greater.

12. Governing law

These Terms are governed by the laws of [Your State/Country], without regard to its conflict-of-law provisions. Any dispute arising from these Terms or the Service will be resolved in the courts located in [Your Jurisdiction].

13. Changes to these Terms

We may update these Terms from time to time. We will post the updated Terms and update the "Last updated" date. Continued use of Qualia after changes means you accept the new Terms.
